•By purchasing any commission, you agrees to be bound by these Terms of Service.

•All prices are in USD, and payment must be made in full upfront.

•Turnaround time is usually 7–14 days after references and/or sketches are approved. Complex or high-volume orders may take longer.

•Requests for modifications made more than 7 days after delivery may incur additional charges.

•Finished files will only be stored for up to 6 months. Please make sure to download and back up your files, as they may not be available after this period.

•Delays in providing commission details can disrupt the workflow and timeline. Please ensure details are submitted promptly to avoid complications. As funds may be withdrawn early, issuing refunds can take time.

•Allowed use: emotes, profile pictures, alerts, or overlays.

•Not allowed: editing, recoloring, animating, tracing, redrawing, or altering in any way.

•Reselling, redistributing, or transferring ownership is strictly prohibited, even if unused.

•When used in a server/channel, clients must ensure others cannot freely take, copy, or distribute the assets.

•Effective July 1 2022, any order placed (files) before this date will no longer be available due to complete loss of files.

•If all commission slots are full, you may request to join the waitlist.

•Start dates are not guaranteed. Current orders are completed first. Estimated wait: ~2–4+ weeks, depending on the queue, character count, and complexity.

•When a slot opens, the next client will be contacted. If there is no response within 3 days, the slot will be offered to the next person.

•No payment is required until the commission begins.

•Check the current commission status and available slots here before requesting.

COMMISSION STATUS

•🟢 OPEN — Slots available. First come, first served via email, Ko-fi, Etsy, or VGen.

•🟡 LIMITED — Waitlist open. New requests are added to the queue and started later.

•🔴 CLOSED — Not accepting new commissions or requests while focusing on the current queue.

•YCH/recolor orders use a separate fast lane and may be completed before custom commissions.

•YCH orders do not affect custom commission ETAs.

•YCH commissions require you to provide a completed character design. Custom character creation is not included.

•The pose, expression, and layout are predetermined. Only colors, markings, and accessories may be adjusted to match your reference.

•Some YCH orders may have no revisions and will be drawn according to the provided reference.

•Personal use only. Resale, redistribution, or claiming the base/template as your own is prohibited.

•All commissions are charged in USD through a PayPal invoice or the platform being used, and payment must be made upfront.

•We are not responsible for any fees or taxes associated with the transaction when using PayPal or the platform being used. Any applicable fees will be the sole responsibility of the buyer.

•Prices are final and non-negotiable.

•Cancellation requests must be made before work begins.

•Once the first draft or sketch has been delivered, refunds are no longer available.

•If no draft sketch is delivered within 7 days of payment, you may request a refund, minus any applicable processing fees.

•In the rare event I’m unable to complete your commission after payment, a refund will be issued (excluding external fees).

PERSONAL LICENSE

•All orders and digital products are delivered with a personal license by default.

•Delivered works may be used on channels, streams, or videos, even if monetized.

•If an animator is hired to animate the work, proper credit to xketam must be provided. Rig-ready files will not be provided, as artworks are created in merged layers rather than separated for animation.

•I retain copyright and ownership of the artwork.

COMMERCIAL USE LICENSE

•A commercial license grants the right to use the work for profit-making purposes.

•A commercial license fee of 100% of the original order or product price will be applied.

•Commercial use includes: Merchandise (stickers, shirts, keychains, prints, etc.) Digital products or paid packs (Patreon/Ko-fi rewards, etc) branding for a business, company, or VTuber agency. Assets included in products or services that are sold.

•I retain copyright and ownership of the artwork.

•Using any of my works as a reference during a livestream without permission is not allowed.

•I am not obligated to contact or notify clients, streamers, artists, or other parties if my work, including commissioned pieces, is copied, traced, recolored, or otherwise used without permission. If my work is found to have been used in this manner, I reserve the right to issue a DMCA takedown or take other appropriate action without prior notice.

•Any alteration, editing, or use of my works utilizing AI is not allowed.

•Reposting or redistributing any of my works, including through automated accounts or bots, is not permitted without permission, regardless of whether the work is claimed to be used as a reference.

•The use of my artwork with AI tools is strictly prohibited, including uploading, training, processing, modifying, or generating new works from my artwork.
